Privacy Policy

The Privacy Policy of SailCraft Sławomir Gronowski Marek Polniak Civil Partnership is effective from March 12, 2024.

A. General Provisions

  1. The administrator of personal data at SailCraft Sławomir Gronowski Marek Polniak Civil Partnership, located in Mosty (81-198) at Wiązowa Street 64, registered in the Central Register and Information on Business Activity (CEIDG), operates under the tax identification number NIP: 5871744717 and statistical number REGON 527666751 (hereinafter referred to as the Company). The protection of personal data is carried out in accordance with the principles set out in the Regulation of the European Parliament and Council EU 2016/679 of April 27, 2016 (hereinafter "GDPR") and the Personal Data Protection Act of May 10, 2018 (Journal of Laws of 2019, item 17811).

  3. To standardize the terms, the following glossary is used.

Administrator - SailCraft Sławomir Gronowski Marek Polniak Civil Partnership located in Mosty (81-198) at Wiązowa Street 64;

Privacy Policy – this document regulating the security of privacy protection and processing of Users' personal data;

Website – the internet service available at www.sailcraft.pl, which the User can use to communicate with the Personal Data Administrator.

User - the entity that has gained access to the services provided on the website www.sailcraft.pl or entered into an agreement with the Administrator for the provision of services;

B. Personal Data

  1. The scope of processed personal data is determined by the data completed by the User and then sent to the Administrator via the appropriate form, varying depending on the service used by the User.

  2. The processing of the User's personal data may concern:
    in the case of organizing training and taking an exam, these are:

  • first name (names and surname);
  • residential address;
  • date of birth;
  • place of birth;
  • phone number;
  • email address
    in the case of participating in a cruise additionally:
  • citizenship;

  • identity document number(s);

  • sailing license number(s);
    other collected data:

  • IP number;

  • date and time of the visit to the website;

  • information about the web browser; hardware; software; operating system; applications and language versions.

  • in the case of mobile devices: device type; operating system and its version; location settings and other system actions. Users' personal data will be processed for the purpose of: (a) fulfilling legal provisions, providing services electronically, (b) promotional and commercial activities of the Administrator.

  1. Providing personal data is voluntary, but failure to consent to the processing of personal data marked as mandatory will prevent the Administrator from providing services.

  2. Users' personal data will be processed for the purpose of:

  • concluding and properly executing the contract or other services related to it, undertaken at the request of the User (Article 6(1)(b) GDPR), including in particular:
    a) organizing sailing, motorboat, and other specialized courses related to water sports;
    b) notifying the Examination Center of participation in the exam for specific sailing or motorboat degrees;
    c) preparing and concluding a participation agreement for the cruise;
    d) preparing and concluding a yacht charter agreement;
    e) developing the crew list;
    f) registering for NWW insurance.

  • fulfilling legal obligations imposed on the Administrator, particularly regarding tax and accounting law (Article 6(1)(c) GDPR)
  • presenting advertisements, offers, or promotions of services provided by the Administrator and its partners intended for all recipients, including for the purpose of fulfilling the newsletter service agreement (Article 6(1)(f) GDPR)

  • analyzing and evaluating user activity on the Administrator's websites (Article 6(1)(f) GDPR)

  • considering received complaints (Article 6(1)(f) GDPR)

  • asserting and defending against claims (Article 6(1)(f) GDPR)

  • for other purposes with the User's consent (Article 6(1)(a) GDPR)

  1. The User has the right to:

  • access their personal data and receive copies thereof,

  • rectify (correct) their data,

  • delete personal data,

  • the right to restrict data processing,

  • the right to object to the processing of personal data for reasons related to the User's particular situation, when the Administrator processes data based on its legitimate interest. Such an objection can be expressed at any time by sending correspondence electronically or in writing to the addresses indicated above,

  • the right to file a complaint with the President of the Personal Data Protection Office (to the address of the Personal Data Protection Office, ul. Stawki 2, 00-193 Warsaw) if it is believed that the processing of personal data violates applicable data protection regulations.

  1. Insofar as the User's data is processed based on consent or in connection with the provided service, the User may also exercise the following rights:

  • the right to withdraw consent to the extent that data is processed on that basis. Withdrawal of consent does not affect the lawfulness of processing that was carried out based on consent before its withdrawal.

  • the right to data portability, i.e. to receive from the Administrator the User's personal data in a structured, commonly used, machine-readable format.

  1. Personal data will be stored for no longer than is necessary to achieve the purpose for which they are processed. Data may be stored longer if required by applicable legal regulations.

C. Confirmation of personal data processing.

  1. Users' personal data may be entrusted for processing solely for the purpose of fulfilling contracts concluded with the Administrator to the following entities:

  • companies mediating in yacht charters

  • charter companies

  • yacht skippers and sailing instructors

  • courier companies and Polish Post

  • insurance agencies and brokers

  • financial institutions handling transfers and online payments

  • companies (Examination Centers) conducting sailing qualification exams

  • local authorities approving crew lists

  • IT and hosting companies.

  1. The data processor of Users' personal data, based on the Entrustment Agreement, will process Users' personal data from the entry into force of GDPR through another entity, solely on the basis of prior consent from the Administrator. Personal data collected by the Administrator may also be disclosed to: relevant state authorities upon their request based on applicable legal provisions, or to other persons and entities in cases provided for by law.

D. Information security.

  1. The Administrator applies technical and organizational measures to ensure the protection of processed personal data specified in Articles 25, 30, 32-34, 35-39 of GDPR, ensuring enhanced protection and security of Users' personal data, appropriate to the threats and categories of data covered by protection, and in particular, technically and organizationally secures data against unauthorized access, removal by unauthorized persons, processing in violation of the law, and alteration, loss, damage, or destruction, including the use of SSL (Secure Socket Layer) certificates. The collection of Users' personal data is stored on a secured server, and the Administrator's internal procedures regarding personal data processing and information security policy also protect the data.

  2. The Administrator also points out that using the Internet and services provided electronically may involve specific information security risks, such as the presence and operation of internet worms, spyware or malware, including computer viruses, as well as the possibility of being exposed to cracking or phishing (password fishing), and others. To obtain detailed and professional information regarding security practices on the Internet, the Administrator recommends consulting entities specializing in such IT services.
