Reservation Regulations.

Regulations for reserving trainings, cruises, and charters atSailCraft Sławomir Gronowski Marek Polniak Civil Partnershipare effective from March 12, 2024.

 

A. General Information.

  1. This document regulates the rules for making reservations, canceling reservations, methods and deadlines for payment for reservations, confirmations of reservations made, and complaints atSailCraft Sławomir Gronowski Marek Polniak Civil Partnership, ul. WIązowa 64, 81-198 Mosty, tel. 600310665, e-mail: biuro@sailcraft.pl (hereinafter: "SailCraft").
  2. Descriptions of trainings, cruises, and charters on the SailCraft website: sailcraft.pl do not constitute an offer within the meaning of Art. 66 § 1 of the Civil Code, but are an invitation to conclude a contract. The data contained in these descriptions are for informational purposes and may change before the contract is concluded.
  3. Prices listed on the SailCraft website are gross prices.
  4. The transaction is conducted in PLN currency. Prices listed in other currencies are indicative and are converted at an approximate rate.

  5. When reserving a yacht that requires qualifications for its operation, the Client or a person designated by the Client to operate the yacht should have the appropriate and valid documents confirming sailing or motorboat qualifications at the time of its pickup.

  6. All reservations made on the websitewww.sailcraft.plcan only be made by adults. If a reservation is made by a person under the age of 18, the reservation will require confirmation from a legal representative or guardian.

B. Complaints.

  1. If the Client finds defective performance of the contract during the service (i.e., not in accordance with the reservation conditions and the description of the service/product provided on the SailCraft website), they should immediately notify the service provider (using the contact form on the SailCraft website, sending a message to: biuro@sailcraft.pl or by phone at +48600310665).
  2. The time for resolving a submitted complaint is 14 days.
  3. Any refund resulting from a complaint will be made by transfer to the bank account number provided by the Client.

C. Canceling Reservations.

  1. A reservation can be canceled by notifying the service provider (using the contact form on the SailCraft website, sending a message to: biuro@sailcraft.pl or by phone at +48600310665) no later than 21 days before its start.
  2. In the case of canceling a reservation according to point C.1, the refund for the reservation will occur within 14 days after its cancellation by transfer to the account indicated by the Client.
  3. If the Client fails to meet the conditions in point C.1, SailCraft will charge the Client for the cost of the service reservation.
  4. In the event of the Client's absence on the day of the training/cruise/charter, SailCraft will charge the Client the full price for the reserved service and will allocate the amounts paid for the reservation towards this purpose - similarly if the Client does not complete the classes in the form provided for them or withdraws from the service before its completion after the cruise/charter has started.

D. Personal Data

  1. During the reservation process, the Client consents to the inclusion of their personal data in the SailCraft database.
  2. This data will be used solely for the purpose of enabling the full reservation process in accordance with the provisions of the Act of August 29, 1997 on the protection of personal data.
  3. In cases and under the principles specified in the Act of August 29, 1997 on the protection of personal data (Journal of Laws 2002, No. 101, item 926 as amended), the Client has the right to request the completion, updating, correction of personal data, temporary or permanent suspension of their processing or their deletion if they are incomplete, outdated, untrue, or were collected in violation of the law or are no longer necessary for the purpose for which they were collected.

E. Online Payments

  1. The payment operator isPayPro SA– An entity providing the Service for Users, based in Poznań, at ul. Pastelowa 8 (60-198), entered in the register of entrepreneurs of the National Court Register maintained by the District Court Poznań Nowe Miasto and Wilda, VIII Economic Division of the National Court Register under KRS number 0000347935, NIP number 7792369887, with a share capital of 4,737,100.00 PLN, fully paid up and registered in the register of national payment institutions maintained by the Financial Supervision Authority under UKNF IP24/2014.

F. Final Provisions

  1. The cost of the reservation is determined separately for each service. The reservation cost refers to the amount paid during the reservation process of the service:
    a) for short-term services (up to 3 days) - 100% of the service price.
    b) for long-term services (4 days and more) - 50% of the service price
  2. To book the service, the applicant should:
    - use the "Book Appointment" button on the sailcraft.pl website (on the page of the booked service), fill out the application form, and make the required payment amount through the online payment system
    - or
    - after sending the application electronically to the address biuro@sailcraft.pl, make the established reservation fee payment to the bank account of SailCraft Sławomir Gronowski, Marek Polniak Civil Partnership, account number 96116022020000000602054117, indicating the date and name of the service in the title
  3. The reservation agreement is considered concluded upon sending a confirmation of order fulfillment to the email address provided by the Client ("Your order has been accepted") and after the Client has made the payment.
  4. The Client is responsible for correctly filling out the data in the reservation form. SailCraft is not responsible for incorrect completion of the data form or improper selection of the date of activities.
  5. SailCraft reserves the right to cancel or change the dates of the booked services. In such a case, the Client has the right to withdraw from the reservation agreement and receive a refund of the paid amount.
  6. The Client agrees to participate in the reserved activities and acknowledges that failure to appear on the day of their commencement forfeits the right to withdraw from the agreement (Art. 38, Sec. 1 of the Consumer Rights Act of May 30, 2014, as amended).
  7. The Client accepts the possibility of being removed from the conducted activities in case of violating health and safety regulations or failing to comply with the instructor's instructions - without the right to a refund of the training fee.
  8. For safety reasons, participation in trainings, trips, and charters is prohibited for individuals under the influence of alcohol, drugs, narcotics, or psychotropic substances.
  9. Checking the option "I have read the Regulations" means that the Client has familiarized themselves with the reservation regulations, understands its provisions, agrees to the conditions contained therein, and accepts the conditions of the selected offer. Lack of such acceptance will result in the inability to make an online reservation.
